Unfiled Returns

Non-Filers

The IRS estimates that approximately 10 million taxpayers fail to file their federal income tax returns each year. Some of the most common reasons include:

  • Procrastination
  • Not understanding the filing requirement
  • Willful and intentional avoidance

Regardless of the reason, the IRS identifies these citizens as "non-filers."

Identifying the Non-Filers

The IRS has targeted non-filers as one of its highest priorities. In recent years, the IRS has developed technology designed to identify and locate taxpayers who are not filing tax returns. In short, the IRS has become more successful in identifying and pursuing non-filers. Willful failure to file a tax return is a misdemeanor carrying a maximum sentence of one year in prison for each tax year. Worse yet, tax evasion is a felony, carrying a maximum sentence of five years in prison for each tax year. Do not risk criminal tax prosecution. Obtain voluntary compliance with your income tax return filing obligations now.

Voluntary Compliance May Reduce Your Risks

Non-filers are often more closely examined by the IRS. For that reason, among others, you need experienced legal counsel to provide:

  • an extra level of care and accuracy in preparing delinquent tax returns
  • a comprehensive plan for filing returns within IRS compliance procedures
  • advice as to the "next steps" if taxes are owed (Settle Your Tax Debt , release tax liens , or establish an IRS payment plan)

Attorney-Client Privilege

Often, non-filers seek help from an accountant. Federal and state laws recognize a limited accountant-client privilege concerning confidential communications. Only representation by an attorney provides you with the protections of the attorney-client privilege. At The Peck Group, LC, our legal staff understands IRS voluntary compliance requirements and has extensive experience representing non-filers before the IRS and state tax authorities. If you have unfiled tax returns, and seek voluntary compliance, speak with an attorney at 770-952-1000 or contact us by e-mail.
